Offer Terms and Conditions

1. This “Offer” is provided to you by Standard Chartered Bank in India (“Bank”) and Amazon Pay (India) Private Limited (formerly known as Amazon Online Distribution Services Private Limited) (“Amazon”) and made available on the website www.amazon.in and the mobile site and mobile application thereof (collectively, “Amazon.in”).
2. These Offer terms and conditions (“Offer Terms”) are in addition to the Amazon.in Conditions of Use & Sale and Privacy Notice to which you agree to by using Amazon.in. In the event of any conflict between the Conditions of Use & Sale and these Offer Terms, these Offer Terms will prevail, only for the purposes of this Offer.
3. All residents of India holding a valid credit card or debit card issued by the Bank (each a “Card”) are eligible to avail the Offer (each a “Cardholder”).
4. The offer is valid from 00:00 Hrs to 23:59 Hrs on October 15^th, 22^nd and 29^th, 2021 for Amazon Prime members and Standard Chartered Cardholders only.
5. Under this Offer, any Cardholder who, during the Offer Duration, makes any purchase of an eligible product from Amazon.in (website or app) and makes the payment using the Card, will be entitled for 10% instant discount as per the above offer construct, provided the purchase value for such transaction (inclusive of taxes) is equivalent to or exceeds INR 2,5000 (on Grocery) and INR 5,000 for other categories on a per transaction basis.
6. The purchase of the product(s) will be governed by the terms of sale, including terms of exchange (wherever available), applicable to the sale of the product(s) on Amazon.in. This Offer will also be applicable on purchase of product(s) by the Cardholders under an exchange offer.
7. Notwithstanding anything contained in these Offer Terms, this Offer is not applicable on the purchase of the following products:
   1. Gift Card(s) (Amazon branded and Non Amazon branded)
   2. All types of Prepaid Recharges (Mobile, DTH, Google Play, Subscriptions, Cable TV, Metro and any other type of prepaid recharge
   3. All types of Bill Payments
   4. Digital Gold purchases and sales
   5. Kindle e-books and Kindle Unlimited Subscription Program

   7. Amazon Pay balance loading

11. The Instant Discount would not be applicable on payment made by Cardholders using the on Delivery’ payment option.
12. The Offer is also valid on EMI (equated monthly instalment) transactions, No Cost EMI transactions and Exchange offers. The offer is not valid on Down-Payment EMI option.
13. The Instant Discount will be calculated on the final amount charged on Standard Chartered credit/debit card.
14. In the event the order is returned or cancelled by the Cardholder, seller or Amazon Seller Services Private Limited, for any reason whatsoever, and subsequently the order / purchase transaction value falls below INR 5000, the order will not qualify for this Offer and the participation of the Cardholder will be deemed withdrawn.
15. In the event orders are cancelled, the customer will not be eligible for the discount.
16. If Instant Discount is availed on any purchase, and the transaction is subsequently cancelled, the refund amount of such orders will be post adjusting the instant discount amount availed on the purchase.
17. Amazon reserves the right, at any time, without prior notice, without liability, and without assigning any reason whatsoever, to add/alter/modify/change or vary all of these Offer Terms or to replace, wholly or in part, this Offer by another offer, whether similar to this Offer or not.
18. All disputes between the Cardholders and the Bank will be resolved inter se and Amazon will not (nor will be liable or obliged to) mediate or resolve any dispute or disagreement between the Cardholders and the Bank.
19. This Offer cannot be availed on: (i) purchase of the ineligible / excluded products mentioned above; or (ii) purchase by Cardholder using any card other than the Card (mentioned above).
20. By participating in this Offer, every Cardholder expressly agrees that Amazon or any of its affiliates will not be liable or responsible for any loss or damage whatsoever that a Cardholder may suffer, directly or indirectly, in connection with this Offer, including but not limited to that associated with his/her use or delivery or misuse of any product purchased on Amazon.in.
21. Free Delivery will not be applicable in case of partial payments.
22. The offer is non-transferable.
23. Standard Chartered Bank does not make any warranties or representation of the quality, merchantability, suitability or availability of the products or services included in this Offer
24. The sellers on website/mobile app shall be responsible for the products purchased by a customer. Neither Standard Chartered Bank nor any of its subsidiaries assumes any responsibility for the service offered by Amazon & its sellers
25. Standard Chartered Bank holds no warranty or makes no representation about the quality offered by the sellers on Amazon. Any dispute or claim regarding the services must be resolved by the customers with Amazon or its sellers, directly without any reference to Standard Chartered Bank.
26. Standard Chartered Bank shall not entertain any such disputes on the quality of products delivered by Amazon even if, the customer approaches the Bank for resolution of the same
27. The participation is voluntary and any purchase on Amazon.in platform using Standard Chartered card shall be deemed as acceptance of the terms and conditions mentioned herein
28. Standard Chartered cardholder will have to make the payment with their Standard Chartered cards only to avail this offer.
29. Standard Chartered Bank holds the exclusive right at its sole discretion to refuse or deny the offer to any Cardholder. The cardholder shall become ineligible to participate in this Offer if his/her card is cancelled before the expiry of /during the Offer Period.
30. Standard Chartered reserves the right to disqualify any Customer from the benefits of the campaign / offer, if any fraudulent activity is identified as being carried out by the customer for the purpose of availing the benefits under the campaign/offer or otherwise by use of the service
31. Any tax or other liabilities or charges payable to the government or any other statutory authority/body or any participating establishment, which may arise or accrue to the client due to provision of the offer, shall be to the sole account of the client.
32. This Offer may be withdrawn or extended at any time at the sole discretion of Standard Chartered Bank & Amazon
33. Standard Chartered Bank is not making any commitment to make such similar offers beyond the Offer period
34. All other terms and conditions of the Cardholder agreement shall continue to apply
35. Standard Chartered Bank & Amazon reserves its absolute right at any time to add, alter, withdraw, modify or change or vary any or all the terms and conditions of the Offer at its sole discretion and the same shall be binding on the Cardholder at all times.
36. Standard Chartered Bank & Amazon also reserves the right to discontinue the Offer without assigning any reasons or without any prior intimation whatsoever to the Customers. In case of any dispute, Standard Chartered Bank’s decision shall be binding on all Customers
37. The Offer shall be subject to usual force majeure events and on occurrence of such event, the Offer may be withdrawn at the discretion of Standard Chartered Bank
38. Nothing expressed or implied in the program shall in any way waive or amend any of the applicable terms and conditions on amazon.in/mobile app.
39. Pictures of products shown in the communication sent to the customer either through mailers or advertised on amazon.in website/mobile app, are for representative purpose only and may not bear a resemblance to the actual products sold by the relevant sellers. Standard Chartered Bank shall under no circumstances be responsible towards the same.
40. Products offered under this program are subject to availability from the respective sellers of Amazon and in no circumstances Standard Chartered Bank shall be liable for non-availability of any of the products.
41. Under no circumstance will the offer/Instant Discount being offered under this program be settled in cash
42. Any disputes arising out of the Offer shall be subject to arbitration by a sole arbitrator appointed by both the Parties with mutual consultations for this purpose. The proceedings of the arbitration shall be conducted as per the provisions of Arbitration and Conciliation Act, 1996. The place of arbitration shall be at Mumbai and language of arbitration shall be English.
43. Customers are not bound in any way to participate in the Instant Discount program. By participating in the offer, the participants agree to be bound by the terms and conditions contained
44. All liability with respect to the products purchased lies with the respective seller and Amazon nor Standard Chartered Bank shall be in no way responsible for the same.
45. The offer shall not be available wherever it is prohibited under law and/or cannot be made for any reason
46. Any person availing this Offer shall be deemed to have accepted these Offer Terms & Conditions.
