Terms and Conditions for Standard Chartered Bank Google Pay Service

1.1 These terms and conditions (“Terms”) apply to the service offered by Standard Chartered Bank (Singapore) Limited (the “Bank”, “we” or “Standard Chartered Bank”) for you to link your Standard Chartered Bank account(s) (“Account(s)”) to the “Google Pay” digital payment platform provided by Google LLC (such platform to be referred to as the “Google Pay App”) in order to perform funds transfers via the Bank’s PayNow service on the Google Pay App. The aforesaid shall collectively be referred to as the “Standard Chartered Bank Google Pay Service”.

1.2 A fund transfer via the Bank’s PayNow service performed on the Google Pay App shall also be referred to as a “PayNow Transfer” as defined in the Terms and Conditions for use of PayNow with Standard Chartered (“PayNow T&Cs”). You agree that the PayNow T&Cs shall also apply to you in respect of each PayNow Transfer you perform via the Google Pay App, regardless of whether you are a PayNow Individual Registered User (as defined in the PayNow T&Cs). Google LLC shall be a “Third Party Platform Provider” and the Google Pay App shall be a “Third Party Platform”, each as defined in the PayNow T&Cs.

1.3 In order to link your Account(s) for the purposes of the Standard Chartered Bank Google Pay Service, you must first have a valid Account and be registered as a user of the Google Pay App. You understand that your PayNow Transfers on the Google Pay App will be subject to same total maximum daily transfer limit (calculated on a cumulative basis) of S$1,000, regardless of whether you are a PayNow Individual Registered User.

1.4 By linking your Account for the purposes of the Standard Chartered Bank Google Pay Service, you agree that:

  1. you are bound by these Terms (as may be amended from time to time) and the PayNow T&Cs (as may be amended from time to time). The PayNow T&Cs may be accessed at https://www.sc.com/sg/terms-and-conditions/paynow/
  2.  these Terms are in addition to the Bank’s Customer Terms (including the PayNow T&Cs), the Current/Cheque/Savings Account and Time Deposit Terms, and any other documents forming part of our banking agreement (collectively, “Relevant Terms”). Such terms may be accessed at https://www.sc.com/sg/terms-and-conditions/personal-banking/;
  3. the meaning of key words printed in italicised fonts like thisis explained in our Customer Terms. Some additional key words which apply to the services referred to in these Terms are defined in these Terms; and
  4. if there is any conflict or inconsistency, these Terms shall prevail over the Relevant Terms to the extent of such conflict or inconsistency.

2. Definitions
2.1 “Client Contact Centre” means the Bank’s hotline for Personal Banking at
(+65) 6747 7000;

2.2 “Enabled Device” means a compatible electronic equipment on which an Account has been successfully enrolled in the Google Pay App for use of the Standard Chartered Bank Google Pay Service; and

2.3 “Security Procedure” means any security or authentication procedure specified by the Bank or Google LLC from time to time in connection with the enrolment of an Account or use of such account on the Google Pay App.

3. Use of Google Pay App / Security Procedure
3.1 Enrolment and Security Procedures
You must comply with such Security Procedure(s) as may be designated (whether by Google LLC or the Bank) for the enrolment of your Account on the Google Pay App. Any person who can unlock your Enabled Device and login to your Google Pay App can authorise PayNow Transfers through the Google Pay App. No further Security Procedure(s) or authentication may be required by the Bank before a PayNow Transfer is authorised. You must not let anyone else, including family members, have their fingerprint or facial image (as the case may be) registered to your Enabled Device(s) while your Account is enrolled on the Google Pay App. You must keep your Enabled Device(s) safe and secure at all times, and keep secret your Enabled Device’s passcode, Personal Identification Number (“PIN”), pattern, or any other means of unlocking your Enabled Device as the case may be. You are solely responsible for maintaining the confidentiality of your Google User ID, Google passwords and any other Security Procedures that you may from time to time have to access the Google Pay App.

3.2 Debit of Account
You instruct and authorise the Bank to debit your Account and transfer or procure the transfer of the Transfer Amount to the relevant bank account of the intended Recipient in relation to each PayNow Transfer request, made or effected via any Enabled Device(s), where any Account has been enrolled on multiple Enabled Device(s), and in each instance, whether by you or any other person (whether with or without your knowledge or authority). Subject to Clause 3.5 below, this Clause 3.2 applies notwithstanding that the PayNow Transfer was effected by the use of the Standard Chartered Bank Google Pay Service after the loss or theft of any Enabled Device(s) or disclosure of any Security Procedure in respect of the Standard Chartered Bank Google Pay Service

3.3 We reserve the right and discretion to:

  1. refuse to allow your Account to be debited for a PayNow Transfer;
  2. determine which source account will be eligible for use for a PayNow Transfer; or
  3. modify, terminate, suspend or discontinue PayNow temporarily or permanently,

without giving you any prior notice or reason. You agree that we will not be liable to you or any third party for any block, modification, restriction, suspension, disqualification or termination of your use of the Account or Standard Chartered Bank Google Pay Service.

3.4 Duty to Notify Us
Should you discover that your Enabled Device is lost or stolen or that your Enabled Device, Google Pay App, or Account has been compromised, accessed or used in an unauthorized way, you shall notify us of the loss/theft or compromise/unauthorised access/use by calling our Client Contact Centre  or by visiting any of our branches. If we request so, you agree to make a police report on the unauthorised payment transaction to facilitate our claims investigation process, and to give us a copy of the police report. We may require that you give us a copy of the police report before we begin any claims resolution process.

3.5 Liability for Lost/Stolen Device/Unauthorised Use or Access
You shall not be liable for any unauthorised PayNow Transfers carried out after we have been notified of any loss/theft of the Enabled Device or unauthorised access or use of the Standard Chartered Bank Google Pay Service. However, we shall debit your Account for all PayNow Transfers carried out before we are notified of such loss/theft/unauthorised access or use, even if such transactions were carried out without your authorisation. Notwithstanding the foregoing, if your Account is a protected account, the liability provisions as specified in the Customer Terms (Clauses 20.2A to 20.2F) will apply.

3.6 Lost/Stolen Enabled Devices
In respect of any Enabled Device reported as lost or stolen, if the Enabled Device is subsequently retrieved, you must remove your Account from the Google Pay App and comply with such activation, security and other procedures as may be prescribed by us or Google LLC from time to time in order to re-enrol the Account on the Google Pay App.

4. Payment
4.1 Liability for Transactions
Save only to the extent that your liability has been expressly excluded in accordance with Clause 3.5 above, and without prejudice to Clauses 20.2A to 20.2F of the Customer Terms, you shall be liable for all PayNow Transfers effected via the Standard Chartered Bank Google Pay Service, whether or not executed with your knowledge or authority, regardless of how such transactions were effected, including; where such PayNow Transfers arose in connection with any negligence on your part (which shall be deemed to include without limitation where you fail to adopt the security measures referenced in Clause 9.2, or carelessly expose yourself to any security risks, including as referenced in Clause 9.1).

4.2 Charges
You shall be responsible for any service charges or fees payable in connection with the enrolment and use of your Account through the Google Pay App including such charges or fees imposed by equipment vendors, software companies, internet or communication services providers or other third parties.

5. Termination of Account
5.1 Our Right to Terminate
We may suspend or terminate your Account, and so your access of your Account on any Enabled Device through the Google Pay App at any time. Without prejudice to the generality of the foregoing, we may terminate your Account, and your access of your Account on the Google Pay App, in the event of any change of your Account status, credit history or rating, or to any mandate or instructions relating to the operation of any Account.

5.2 Your Right to Terminate
Use of the Standard Chartered Bank Google Pay Service may be terminated by you by removing your Account on the Google Pay App according to procedures prescribed in the Google Pay App from time to time.

5.3 Obligations Upon Closure of Account
Upon the closure of your Account(s) for whatever reason, you must remove your Account on the Google Pay App from all Enabled Device(s).

6. Exclusions and Exceptions
6.1 Without prejudice to Clauses 20.2A to 20.2F of the Customer Terms, the Bank
shall not be liable to you or any third party for any and all losses, liabilities, costs, expenses, damages, claims, actions or proceedings of any kind whatsoever (whether direct, indirect or consequential) in respect of any matter of whatever nature and howsoever arising (whether in contract, tort, negligence or otherwise) in connection with:

(a) the provision by the Bank of or your use of PayNow through Google Pay App;

(c) any unauthorised access and/or use of your Enabled Device(s) and/or PayNow through Google Pay App;

(d) the use in any manner and/or for any purpose whatsoever by any person at any time whatsoever and from time to time of any information or data relating to you and/or any Recipient;

(e) any event the occurrence of which the Bank is not able to control or avoid by the use of reasonable diligence; and/or

(f) the suspension, termination or discontinuation of the Standard Chartered Bank Google Pay Service.

6.2 You shall indemnify, defend and hold harmless the Bank and its representatives, affiliates and service providers from and against any consequences, claims, proceedings, actions, losses, damages, costs (including all legal costs on an indemnity basis), liabilities or expenses, whether foreseeable or not, resulting from or arising in connection with any fault, act or omission by you (including but not limited to your negligence, misconduct or breach of any of these Terms).

6.3 Account and Security Procedures
Without prejudice to Clauses 20.2A to 20.2F of the Customer Terms, we are not liable in any way for:
(a) any delay or inability on our part to perform any of our obligations under this Agreement because of any electronic, mechanical system, data processing or telecommunication defect or failure, Act of God, terrorism, civil disturbance or any circumstances beyond our control or the control of any of our servants, agents or contractors;

(b) (i) any loss, theft, use or misuse of your Account, Google  Pay App, or Enabled Device, or disclosure of your passcode, PIN, pattern, or any other means of unlocking your Enabled Device, and/or compromise of any Security Procedure, or any breach of  these Terms;

(ii) any fraud and/or forgery perpetrated on us, Google LLC, or any PayNow user;

(iii) any injury to your character and reputation in relation to any inability to use the Standard Chartered Bank Google Pay Service;

(c) the interception by or disclosure to any person (whether unlawful or otherwise) of any data or information relating to you, any PayNow Transfer, or your Account transmitted through or stored in any electronic system or medium, howsoever caused;

(d) any delay, inability or failure by us to perform any of our obligations under or pursuant to these Terms caused or contributed in any way by any one or more of the events or occurrences set out in this clause;

(e) any claim, loss, damage, delay, inability to use, or any mistake or error arising in connection with any hardware, software or service used or provided in connection with any Enabled Device or any inability to use the same. You agree and acknowledge that the use of the Standard Chartered Bank Google Pay Service is made available on an “as-is”, “as-available” basis, that it is not warranted to be error-free and that all risk associated with any use thereof shall be borne by you; and/or

(f) any breach of any obligation of confidentiality by any third party provider of any service or facility associated with any Enabled Device or the Standard Chartered Bank Google Pay Service.

7. Conclusive Evidence
Our records (including electronic, computer and microfilm stored records) of all matters relating to your Account, Enabled Device or PayNow Transfers through Google Pay, and/or of you shall be conclusive of their accuracy and authenticity and shall be binding on you for all purposes whatsoever. We shall be entitled to treat any person in physical possession and control of any Enabled Device as the rightful holder or user thereof, and are entitled to rely upon any use of the Standard Chartered Bank Google Pay Service as conclusive evidence of the fact that the PayNow Transfer relating thereto was authorised and properly made or effected by the Account holder, and subject to Clause 3.5, shall not in any way be liable for any loss, costs, or damages suffered by any person including the rightful holder of the Account with respect to any PayNow Transfer effected through the Enabled Device.

8. Disclosure of Information
By using the Standard Chartered Bank Google Pay Service, you consent to the Bank disclosing any information relating to you, your PayNow Transfer or Account (collectively, “Information”) to the Google Pay App operator or provider, and its customers/users, in order to allow such operator or provider to provide the Google Pay App services. To the extent that “Information” comprises personal data, such personal data will be disclosed by the Bank to the aforesaid parties in accordance with the Bank’s privacy statement available at www.sc.com/sg/privacy.

9. Malware, Phishing and other Risks
9.1 Security Risks
You acknowledge and agree that any use of the Standard Chartered Bank Google Pay Service, or Enabled Devices over the internet or other communications networks is subject to security risks. Such risks may include:

(a) monitoring and recording of your personal data, transactions, usage patterns and Security Procedure responses;

(b) use of the aforementioned information to perform unauthorised transactions or to commit or facilitate crime;

(c) installation of malware, viruses, Trojan horses, worms, monitoring or malicious code on your devices and/or systems;

(d) malfunctioning Enabled Devices, Google Pay App, network connections or hardware failure;

(e) “phishing” or other fake websites or emails which mimic the appearance of the websites of the Bank or Google LLC (or their representatives, affiliates and service providers) or official communications; and

(f) “man-in-the-middle” or other interception of your communications with the Bank, Google

LLC, or any of their representatives, affiliates, or service providers. You acknowledge that use of PayNow through Google Pay carried out over the internet or other communications networks is entirely at your own risk.

9.2 Security Measures
You must adopt security measures as appropriate to avoid such risks, which must include:

(a) you must not disclose your security details to any third party persons or websites or disclose or compromise any Security Procedure and you must inform us immediately upon being aware of any suspected fraud or compromise relating to your Account, Enabled Device(s) or Security Procedure;

(b) you must equip any personal computer or other devices (where relevant) used to effect PayNow Transfers including Enabled Device with the latest anti-virus, anti-malware and firewall software, and ensure that the installed software is regularly updated;

(c) you must not jailbreak or modify your Enabled Device(s), or install illegitimate mobile applications on your Devices;

(d) you must not allow any third party to use, operate or control any Device(s), your Google Pay App, or your Account; and

(e) you must comply with all security practices prescribed by us, and/or any policy or security advisory bulletin we may issue from time to time, including those set out at https://www.sc.com/global/security-tips/.

10. General
10.1 Governing Law
These Terms are governed by the laws of Singapore and parties submit to the non-exclusive jurisdiction of the courts of Singapore.

10.2 The Bank is not the provider of and is not responsible for the Google Pay App, the terms of use or privacy policies associated with the Google Pay App, or any apps integrating its functionality with the Standard Chartered Bank Google Pay Service. You are solely responsible for any information you transmit to the Google Pay App.

Deposit Insurance Scheme
Singapore dollar deposits of non-bank depositors are insured by the Singapore Deposit Insurance Corporation, for up to S$100,000 in aggregate per depositor per Scheme member by law. Foreign currency deposits, dual currency investments, structured deposits and other investment products are not insured.
